Representation of Health Care Professionals

 

As a health care professional himself, Dr. Quinn recognizes the issues that health care workers face on a daily basis.  He is sensitive to the needs and landscape within which individual medical professionals must work, including time limitations and cost restraints.  Accordingly, a portion of the practice is devoted to providing quality, affordable and results-orientated representation to individual and small group health care providers throughout New Jersey.

 

On behalf of health care professionals, services are primarily litigation based in areas of consumer fraud prosecution and consumer fraud defense, workers compensation medical provider claims,  restrictive covenant litigation, commercial and contractual disputes between physicians and medical companies, along with disciplinary and criminal matters ranging form Health Care Fraud and Abuse to simple traffic matters.  Dr. Quinn will also serve in capacity of Personal Counsel for purposes of issues related personal asset exposure.

Representative Cases -  Health Care Professionals

 

Workers Compensation Medical Provider Claims - Representation of providers and facilities for non -payment and increase payment of non-paid claims and underpayment of claims.

Osteopathic physician – Favorable negotiation of a restrictive covenant (non-compete agreement) on behalf of a local physician who had left her at-will employment with a physician group.  Dr. Quinn was able to successfully demonstrate that the terms of the agreement were overly expansive and against public policy as initially written.  He was able to curtail the terms of the restrictive covenant to include unrestricted admission and unlimited treatment privileges at hospitals located within the restricted area on behalf of the physician.

 

Chiropractor – Successful litigation defense and ultimate dismissal obtained of charges of violations for the New Jersey Civil RICO Act (Racketeer Influenced and Corrupt Organizations Act), Consumer Fraud, Common Law Fraud, and Contract claims on behalf of a California Chiropractor and his medical device corporation. 

 

Dentist – Successful dismissal obtained on behalf of a local dentist being sued in a contract dispute by a large medical device corporation. 

 

Nurse – Successful defense and acquittal obtained through trial of a N.J.S.A. 6:B (2) charge carrying a mandatory minimum 1-year loss of driving license.  On behalf of the nurse, Dr. Quinn tried the case and was successful in defeating the charge and saving this nurses’ driving privileges and preserve her ability to commute to her hospital. 

 

Podiatrist – Successful recovery on behalf of a podiatrist in a  consumer fraud action against a medical device company.  The claim sought reimbursement for medical screening equipment purchased under false pretenses and misrepresentations.  

 

Home Nursing Home Company- Incorporation and Attorney to Home Nursing Corporation located in Monmouth County.

Home Nursing Home Company - Defense of a trademark infringement matter for health care company located in Monmouth County.

​

Nurse- Defense and ultimate license restoration through the New Jersey Board of Nursing for a Nurse facing permanent license suspension due to a CDS conviction.

​

Podiatrist- Personal counsel representation of a podiatrist with exposure due to medical malpractice.

​

Physical Therapist- Successful defense of a New Jersey Physical Therapist charged with violation of restrictive covenant.

​

Resident Physicians- Employment contract reviews on behalf of podiatric and medical residents recently completing residency programs.
